1. Agreement to Terms

By accessing our website or engaging Straight Edge Landscaping ("Company," "we," "us," or "our") for any landscaping, lawn care, hardscaping, irrigation, or related services, you ("Client," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

Straight Edge Landscaping provides professional landscaping services including but not limited to: landscape design, lawn care and maintenance, hardscaping, paver patios and walkways, artificial turf installation, xeriscaping, and irrigation system installation and repair. All services are subject to availability and scheduling at our sole discretion.

We reserve the right to refuse service to anyone for any reason at any time. Service scope, pricing, and timelines provided in estimates are subject to change based on site conditions, weather, material availability, and other factors discovered during the course of work.

3. Estimates and Pricing

All estimates are valid for 30 days from the date of issue unless otherwise specified. Estimates are based on visible site conditions at the time of assessment. Additional charges may apply if unforeseen conditions are discovered, including but not limited to: underground utilities, rock formations, drainage issues, soil contamination, pest infestations, or structural problems.

Material costs are subject to market fluctuations. We reserve the right to adjust pricing if material costs increase by more than 10% between the estimate date and project commencement. Client will be notified of any such adjustments before work begins.

4. Payment Terms

A deposit of up to 50% may be required before work commences. The remaining balance is due upon completion of work unless otherwise agreed in writing. For ongoing maintenance services, payment is due within 7 days of invoice date.

Late payments are subject to a service charge of 1.5% per month (18% annually) on the outstanding balance. Client agrees to pay all costs of collection, including reasonable attorney's fees, if legal action becomes necessary to collect unpaid amounts.

We accept cash, check, and major credit cards. A convenience fee of 3% applies to credit card payments.

5. Scheduling and Access

Client agrees to provide clear and safe access to the work area. Any delays caused by lack of access, locked gates, aggressive pets, or other obstructions may result in rescheduling fees and/or additional charges.

Project timelines are estimates only and are subject to weather conditions, material availability, and scheduling demands. We are not liable for delays beyond our reasonable control. Client agrees to mark or identify any underground utilities, sprinkler lines, or other buried items prior to work commencement.

6. Cancellations and Rescheduling

Cancellations must be made at least 48 hours before the scheduled service. Cancellations with less than 48 hours notice may be subject to a cancellation fee of up to 50% of the estimated service cost. No-shows or same-day cancellations will be charged the full service fee.

For larger projects, cancellation after materials have been ordered will result in forfeiture of the deposit and Client responsibility for any non-refundable material costs.

7. Warranty and Guarantees

We stand behind our workmanship. Installation work is warranted for a period of one (1) year from completion date against defects in workmanship. This warranty does not cover normal wear and tear, damage from weather events, acts of God, vandalism, improper maintenance by Client, or damage caused by third parties.

Plant materials are warranted for 90 days from installation, provided Client follows our recommended watering and care instructions. This warranty does not apply if plants die due to drought, flooding, freeze, improper care, pest damage, or disease. No warranty is provided for transplanted plants or plants provided by Client.

Warranty claims must be submitted in writing within 7 days of discovering the issue. Our sole obligation under this warranty is to repair or replace defective work at our discretion. No refunds will be issued for warranty claims.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STRAIGHT EDGE LANDSCAPING'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY CLIENT FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF USE, OR DAMAGE TO PROPERTY NOT DIRECTLY WORKED ON, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

We are not responsible for damage to underground utilities, sprinkler systems, septic systems, or other buried items that were not properly marked by Client or utility companies prior to work commencement.

9. Indemnification

Client agrees to indemnify, defend, and hold harmless Straight Edge Landscaping, its owners, employees, contractors, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from or related to: (a) Client's breach of these Terms; (b) Client's violation of any law or regulation; (c) Client's negligence or willful misconduct; or (d) any claim by a third party related to the property or services.

10. Property Rights and Permits

Client represents and warrants that they are the legal owner of the property or have authorization from the property owner to engage our services. Client is responsible for obtaining any necessary permits, HOA approvals, or other authorizations required for the work. We may assist with permit applications but are not responsible for permit denials or delays.

Any designs, plans, or drawings created by us remain our intellectual property until payment is received in full. Client receives a license to use such materials solely for the completed project.

11. Photography and Marketing

By engaging our services, Client grants Straight Edge Landscaping permission to photograph completed work and use such photographs for marketing, advertising, portfolio, and promotional purposes, including on our website, social media, and printed materials. If you wish to opt out of this, please notify us in writing before work begins.

12. Dispute Resolution

Any dispute arising from or relating to these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be resolved through binding arbitration in Williamson County, Texas, in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding.

CLIENT WAIVES ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. Any claims must be brought in Client's individual capacity and not as a plaintiff or class member in any purported class proceeding.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Williamson County, Texas.

14. Force Majeure

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to: acts of God, weather events, natural disasters, pandemics, government actions, labor disputes, material shortages, or utility failures.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
